WASHINGTON—Two sources familiar with the discussions confirmed that President Joe Biden and his senior aides are discussing issuing pre-emptive pardons for people President-elect Donald Trump has scorned in recent years as he has hinted about plans for retribution.
While the discussions have included certain names, such as Senator-elect Adam Schiff, D-Calif., Dr. Anthony Fauci, and former Rep. Liz Cheney, R-Wyo., sources said the process hasn't progressed to the point of consensus on an actual list.
Some Democrats and "Never Trump" Republicans have supported the notion of pre-emptive pardons to protect people under a new Trump presidency.
Politico first reported that Biden was considering taking the action.

Such pardons have been issued by previous presidents, including George H.W. Bush for former Defense Secretary Caspar Weinberger over his role in the Iran-Contra scandal; Gerald Ford for former President Richard Nixon in the wake of the Watergate scandal; Jimmy Carter for Vietnam War draft dodgers; and Abraham Lincoln for ex-Confederate soldiers.
During the 2024 campaign, Trump made threatening comments about people who he felt had slighted or wronged him.
Speaking at a rally with Tucker Carlson the day before the election, Trump said of Cheney, "She's a far-left war hawk. Let's put her with a rifle standing there with nine barrels shooting at her, OK? Let's see how she feels about it. You know when the guns are trained on her face—they're all war hawks when they're sitting in Washington in a nice building.
Cheney is an outspoken critic of Trump, having also worked on the House select committee that probed the Capitol attack on January 6, which was largely dedicated to uncovering attempts made by Trump to upturn the 2020 results of the presidential elections. Schiff served on that committee too and led the team for the first impeachment trial.
The man accused the end of the 2024 campaign that "the enemy from within" are many Democrats, especially Schiff, who is due to move from the House to the Senate in January. During Trump's first term, he had said he was going to jail because of the "treason" and that Schiff "had better pay a price," all over the first impeachment of Trump.
In fact, Fauci and Trump did not agree on things during the initial term of the president-elect in the White House since Fauci attempted to aid in guiding the federal response to the COVID-19 pandemic. During this time, Trump publicly assaulted Fauci by terming him a "disaster."
There is work being done in the Biden White House on the president's use of clemency authority in criminal justice cases. Advocates, including House Minority Leader Hakeem Jeffries, D-N.Y., and civil rights attorney Ben Crump are encouraging the president to act on a variety of cases they say are worthy of clemency. Adam Schiff, Announcements on those decisions are expected in the coming weeks.
